1 शर्तों की स्वीकृति

इस वेबसाइट का उपयोग करके और हमारी सेवाओं का उपयोग करके, आप इन शर्तों से बंधे होने के लिए सहमत होते हैं। यदि आप इस पृष्ठ पर बताई गई सभी शर्तों से सहमत नहीं हैं, तो कृपया NinzaSMS का उपयोग जारी न रखें।

2 प्रदान की गई सेवाएँ

NinzaSMS बल्क SMS, OTP सत्यापन, WhatsApp Business API, SMS API और संबंधित संचार सेवाएँ प्रदान करता है। हम बिना किसी सूचना के किसी भी सेवा को संशोधित, निलंबित या बंद करने का अधिकार रखते हैं। हम 99.9% अपटाइम बनाए रखने का प्रयास करते हैं लेकिन निर्बाध सेवा की गारंटी नहीं देते हैं।

3 उपयोगकर्ता खाता और सुरक्षा

आप अपने खाते के क्रेडेंशियल्स और API कुंजियों की गोपनीयता बनाए रखने के लिए जिम्मेदार हैं।
आप अपने खाते या API कुंजी के तहत होने वाली सभी गतिविधियों के लिए जिम्मेदार हैं।
आपको हमें अपने खाते के किसी भी अनधिकृत उपयोग या किसी अन्य सुरक्षा उल्लंघन के बारे में तुरंत सूचित करना चाहिए।
हम 180 दिनों से अधिक समय तक निष्क्रिय रहने वाले या हमारी नीतियों का उल्लंघन करने वाले खातों को निष्क्रिय करने का अधिकार रखते हैं।

4 स्वीकार्य उपयोग नीति

NinzaSMS का उपयोग निम्नलिखित गतिविधियों के लिए करना सख्त वर्जित है:

स्पैमिंग: उन उपयोगकर्ताओं को अनचाहे प्रचार संदेश भेजना जिन्होंने ऑप्ट-इन नहीं किया है।
अवैध सामग्री: ऐसी सामग्री प्रसारित करना जो धोखाधड़ी, मानहानिकारक, अपमानजनक, अश्लील है या किसी भी भारतीय या अंतर्राष्ट्रीय कानून का उल्लंघन करती है।
प्रतिरूपण: अपनी पहचान को गलत तरीके से प्रस्तुत करना या प्राप्तकर्ताओं को धोखा देने के लिए नकली सेंडर ID का उपयोग करना।
DLT को बायपास करना: उचित पंजीकरण के बिना DLT-विनियमित ट्रैफ़िक भेजने का प्रयास करना।
अनधिकृत पुनर्विक्रय: सक्रिय रिसेलर समझौते के बिना हमारी सेवाओं को पुनर्विक्रय करना।
उत्पीड़न: ऐसे संदेश भेजना जो किसी व्यक्ति या समूह को परेशान, धमकाते या डराते हैं।

5 बिलिंग, क्रेडिट और रिचार्ज

प्रीपेड प्रणाली: हमारी सभी सेवाएँ प्रीपेड क्रेडिट प्रणाली पर काम करती हैं। हमारी सेवाओं का उपयोग करने के लिए आपको पर्याप्त बैलेंस बनाए रखना होगा।
क्रेडिट कभी एक्सपायर नहीं होते: आपके SMS क्रेडिट कभी एक्सपायर नहीं होते – आप कभी भी उनका उपयोग कर सकते हैं।
न्यूनतम रिचार्ज: मौजूदा उपयोगकर्ताओं के लिए न्यूनतम रिचार्ज राशि ₹200 है और पहली बार उपयोग करने वालों के लिए ₹10 है।
GST लागू: सभी रिचार्ज राशियों पर भारतीय कर कानूनों के अनुसार 18% GST लागू है।
कोई रिफंड नहीं: एक बार खरीदे गए क्रेडिट गैर-वापसी योग्य और गैर-हस्तांतरणीय हैं।
अपर्याप्त बैलेंस: यदि आपका बैलेंस एक OTP/SMS की लागत से कम हो जाता है तो हम API एक्सेस निलंबित करने का अधिकार रखते हैं।

6 DLT पंजीकरण और अनुपालन

सभी प्रचारात्मक SMS को अनुमोदित DLT टेम्पलेट्स के माध्यम से भेजा जाना चाहिए।
आपको TRAI (भारतीय दूरसंचार नियामक प्राधिकरण) दिशानिर्देशों के अनुसार अपने सेंडर ID और टेम्पलेट्स पंजीकृत करने होंगे।
NinzaSMS पात्र ग्राहकों के लिए निःशुल्क अंत-से-अंत DLT पंजीकरण सहायता प्रदान करता है।
आप यह सुनिश्चित करने के लिए जिम्मेदार हैं कि हमारे प्लेटफॉर्म के माध्यम से भेजी गई सभी सामग्री TRAI विनियमों का अनुपालन करती है।
हम DLT अनुपालन का बार-बार उल्लंघन करने वाले खातों को निलंबित करने का अधिकार रखते हैं।

7 API उपयोग और दर सीमाएँ

दर सीमाएँ: प्रति IP पते पर 50 अनुरोध प्रति मिनट और प्रति उपयोगकर्ता खाते पर 100 अनुरोध प्रति मिनट।
दैनिक सीमा: प्रति मोबाइल नंबर पर प्रति दिन अधिकतम 1,000 OTP।
API कुंजी सुरक्षा: आपको अपनी API कुंजी को गोपनीय रखना चाहिए। उजागर API कुंजियों के परिणामस्वरूप होने वाले किसी भी दुरुपयोग के लिए हम जिम्मेदार नहीं हैं।
Idempotency: डुप्लिकेट अनुरोधों को रोकने के लिए idempotency कुंजियों का उपयोग करें।
सेवा व्यवधान: हम रखरखाव या सुरक्षा कारणों से API एक्सेस को अस्थायी रूप से प्रतिबंधित कर सकते हैं।

8 रिसेलर कार्यक्रम

रिसेलर क्रेडिट केवल पुनर्विक्रय के उद्देश्यों के लिए हैं और व्यक्तिगत उपयोग के लिए नहीं हैं।
रिसेलर अपने ग्राहकों के प्रबंधन और यह सुनिश्चित करने के लिए जिम्मेदार हैं कि वे हमारी शर्तों का अनुपालन करें।
हम उन रिसेलर खातों को समाप्त करने का अधिकार रखते हैं जो हमारी नीतियों का उल्लंघन करते हैं या धोखाधड़ी गतिविधियों में संलग्न होते हैं।
निकासी अनुरोध सत्यापन के बाद 24-48 घंटों के भीतर संसाधित किए जाते हैं।

9 खाता निलंबन और समाप्ति

यदि आप इन शर्तों का उल्लंघन करते हैं तो हम बिना पूर्व सूचना के आपके खाते को निलंबित या समाप्त कर सकते हैं।
नकारात्मक बैलेंस या अत्यधिक चार्जबैक वाले खाते तत्काल निलंबन के अधीन हैं।
समाप्ति पर, आपकी API कुंजियाँ रद्द कर दी जाएंगी और आप अपने खाते तक पहुंच खो देंगे।
समाप्ति के समय कोई भी शेष क्रेडिट गैर-वापसी योग्य है।

10 देयता की सीमा

NinzaSMS, उसके अधिकारियों, निदेशकों, कर्मचारियों या सहयोगियों को आपकी इस वेबसाइट या सेवाओं के उपयोग से उत्पन्न या किसी भी तरह से संबंधित किसी भी अप्रत्यक्ष, परिणामी या विशेष दायित्व के लिए उत्तरदायी नहीं ठहराया जाएगा। हमारी कुल देनदारी पिछले 30 दिनों में आपके द्वारा हमें भुगतान की गई कुल राशि से अधिक नहीं होगी।

11 अस्वीकरण

हमारी सेवाएँ "जैसी हैं" प्रदान की जाती हैं, बिना किसी प्रकार की वारंटी के, चाहे वह स्पष्ट हो या निहित। हम यह गारंटी नहीं देते कि सेवा निर्बाध, सुरक्षित या त्रुटि-मुक्त होगी। हमारी सेवाओं के उपयोग से होने वाले किसी भी डेटा, व्यवसाय या लाभ के नुकसान के लिए हम जिम्मेदार नहीं हैं।

12 कानून और अधिकार क्षेत्र

ये शर्तें भारत के कानूनों के अनुसार शासित और व्याख्या की जाएंगी। इन शर्तों से उत्पन्न होने वाले किसी भी विवाद को मुजफ्फरनगर, उत्तर प्रदेश, भारत की अदालतों के विशेष अधिकार क्षेत्र के अधीन हल किया जाएगा।

Welcome to NinzaSMS. These terms and conditions outline the rules and regulations for the use of NinzaSMS's Website and Services, located at ninzasms.in.net.

1 Acceptance of Terms

By accessing this website and using our services, you accept and agree to be bound by these terms and conditions. If you do not agree to all the terms stated on this page, please do not continue to use NinzaSMS.

2 Services Provided

NinzaSMS provides bulk SMS, OTP verification, WhatsApp Business API, SMS API, and related communication services. We reserve the right to modify, suspend, or discontinue any service with or without prior notice. We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.

3 User Account & Security

You are responsible for maintaining the confidentiality of your account credentials and API keys.
You agree to accept responsibility for all activities that occur under your account or API key.
You must immediately notify us of any unauthorized use of your account or any other security breach.
We reserve the right to disable accounts that are inactive for more than 180 days or violate our policies.

4 Acceptable Use Policy

You are expressly prohibited from using NinzaSMS for any of the following activities:

Spamming: Sending unsolicited promotional messages to users who have not opted in.
Illegal Content: Transmitting content that is fraudulent, defamatory, abusive, obscene, or violates any Indian or international laws.
Impersonation: Misrepresenting your identity or using fake sender IDs to deceive recipients.
Bypassing DLT: Attempting to send DLT-regulated traffic without proper registration.
Reselling Without Authorization: Reselling our services without an active reseller agreement.
Harassment: Sending messages that harass, threaten, or intimidate any individual or group.

5 Billing, Credits & Recharge

Prepaid System: All our services operate on a prepaid credit system. You must maintain sufficient balance to use our services.
Credits Never Expire: Your SMS credits never expire — use them anytime without any time restriction.
Recharge Minimum: Minimum recharge amount is ₹200 for existing users and ₹10 for first-time users.
GST Applicable: All recharge amounts are subject to 18% GST as per Indian tax laws.
No Refund: Credits once purchased are non-refundable and non-transferable.
Insufficient Balance: We reserve the right to suspend API access if your balance falls below the cost of one OTP/SMS.

6 DLT Registration & Compliance

All promotional SMS must be sent through approved DLT templates.
You must register your sender IDs and templates as per TRAI (Telecom Regulatory Authority of India) guidelines.
NinzaSMS offers free end-to-end DLT registration assistance for eligible customers.
You are responsible for ensuring that all content sent through our platform complies with TRAI regulations.
We reserve the right to suspend accounts that repeatedly violate DLT compliance.

7 API Usage & Rate Limits

Rate Limits: 50 requests per minute per IP address and 100 requests per minute per user account.
Daily Limit: Maximum 1,000 OTPs per mobile number per day.
API Key Security: You must keep your API key confidential. We are not responsible for any misuse resulting from exposed API keys.
Idempotency: Use idempotency keys to prevent duplicate requests.
Service Disruption: We may temporarily restrict API access for maintenance or security reasons.

8 Reseller Program

Reseller credits are strictly for reselling purposes and cannot be used for personal consumption.
Resellers are responsible for managing their customers and ensuring they comply with our terms.
We reserve the right to terminate reseller accounts that violate our policies or engage in fraudulent activities.
Withdrawal requests are processed within 24-48 hours after verification.

9 Account Suspension & Termination

We may suspend or terminate your account immediately without prior notice if you violate these terms.
Accounts with negative balance or excessive chargebacks are subject to immediate suspension.
Upon termination, your API keys will be revoked and you will lose access to your account.
Any remaining credits at the time of termination are non-refundable.

10 Limitation of Liability

In no event shall NinzaSMS, its officers, directors, employees, or affiliates be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website or services. Our total liability shall not exceed the total amount paid by you to us in the preceding 30 days.

11 Disclaimer

Our services are provided "as is" without any warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data, business, or profits resulting from the use of our services.

12 Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Muzaffarnagar, Uttar Pradesh, India.

13 Changes to These Terms

We reserve the right to update or modify these terms at any time. Changes will take effect immediately upon posting on this page. Your continued use of our services constitutes your acceptance of the modified terms. We recommend reviewing this page periodically for any updates.
